Bail before arrest 


  1. Bail before arrest is bail when After FIR (Complaint), we apply in Court to avoid apprehension of  arrest .
  2. Where to apply for bail before arrest (BBA). You can apply for Bait before arrest or prearrest in session court
  3. Reason, BBA is relief court provide to the people who are innocent and involved in the case with malafide intention of the police or complainant.
  4. And you will have to appear in concert police station and provide all the evidence documentary as well as verbal
  5. And after the investigation if court decide that accused is guilty or involved in the offense, court dismiss the bail before arrest, and police can arrest you any time after dismissal of the application.

Ans: Abori Zamant wo sail ya mulzam karwata hai jis ka kisi FIR main naam aa jata hai  ya wo mulzam jis  ko complainet of FiR supplementary statement main namzad kar deta hai. ya wo person bhi karwa sakta hai jiss ko police namzad na hone ke bawjood tang karti hai .

Benefits of Interim


  1. Iss ke buhat se fayde hain jiss main sab se pehle ye ke mulzam girftari se bach jata hai or court main bail main pesh ho kar asal haqaiq bata deta hai
  2. or Police ne jo remand lena hota hai us ke khalaf wo us remand se bach jata haii
  3. or jesa ke app ko pata hai ke Pakistan main police main IO (taftishi) log kisi bhi begunah bande ko begunah beghair bhari rishwat ke kabhi karar nahi dete . pre arrest se us ki safety ho jati hai

  2. Copy id card
  3. Wakalat Nama
  4. Written Application Under section 498


Proceedure


  1. Tamam Documents ke sath court main through counsel Apply karte hain
  2. Us ke baad Adalat 50000 ya case ke hisab se surety bond (machalka )jama karwane ke baad Agli date de deti hai.Mulzam agli date tak safe ho jata hai .
  3. or court  Mudai muqadma or IO ko with record talb kar leti hai .
  4. Iss tarah kuch dates main court dono parties  ko sun leti hai
  5. Us ke baad ya tu interim confirm hu jati hai ya kharaj hu jati hai or mulzam ko ya tu adalat se bhagna parta hai ya phir girftar kar lia jata hai . yeh ab luck per depend karta hai .
  6. Interim humesha Session court main hi lagai jati hai .
  7. Lower court main ye samat nahi ho sakti
  8. Session court se kharij hone ke baad ap is ko High court main apply kar sakte hain .

ملزمان ضمانت قبل از گرفتای دائر کر کے پہلے تو تاخیری حربے استعمال کرکے اسکو زیادہ سے زیادہ طوالت رینے کی کوشش کرتے ہیں اور جب وہ دیکھتے ہیں کہ جج صاحب اب مزید تاریخ نہیں دیں گے تو جان بوجھ کر غیر حاضر ھو کر درخواست ضمانت قبل از گرفتای عدم پیروی خارج کرا لیتے ہیں اور دوبارہ نئے  سرے سے درخواست ضمانت قبل از گرفتاری دائر کرنے کا سلسلہ شروع کر دیتے ہیں جو کہ قانون کے ساتھ سراسر مذاق ھے

The  policy  of  law  is  that  bail  petitions  should  be  decided within  the  shortest  possible  time.  Nevertheless,  in  a  number  of  cases the  accused  applying  for pre-arrest  bail  first  use  dilatory  tactics  to  gain time  and  then  deliberately  absent  themselves  when  they  feel  that  the presiding  officer  would  not  allow  any  more  adjournments.  If  their  bail application  is  dismissed  for  non-prosecution,  they  start  afresh  in  sheer abuse  of  the  process  of  law.  This  cannot  be  permitted. 
Therefore,  once  a  pre-arrest  bail application  is  admitted  it  must  be  decided  on  merits  in  all eventualities.
