Tenants evicted after the death of the trustee and the trustee. The High Court held that the power of attorney, given by two trustees, remained effective even after the death of one of them because under the endowment, the existing trustees were empowered to appoint someone to conduct the eviction proceedings, and the defect in the power of attorney was subsequently cured by the trustees' action. 2024 Y L R 1011

اہم نکات:

1. کرایہ دار کی بے دخلی:

درخواست گزار (کرایہ دار) کو بے دخلی کے حکم کے خلاف آئینی درخواست دائر کی، جس میں دلیل دی گئی کہ پاور آف اٹارنی غیر مؤثر ہو چکا تھا کیونکہ ایک پرنسپل انتقال کر چکا تھا۔

2. پاور آف اٹارنی میں نقص:

پاور آف اٹارنی دو متولیان نے مشترکہ طور پر دیا تھا، لیکن ان میں سے ایک کی وفات کے بعد کرایہ داری مقدمہ دائر ہوا۔

3. وقف نامہ کے تحت اختیار:

وقف نامہ کے تحت متولیوں کو اختیار حاصل تھا کہ وہ کسی کو بے دخلی کی کارروائی کے لیے مقرر کریں۔

پاور آف اٹارنی میں موجود نقص کو متولیوں نے ضمنی طور پر درست کر دیا۔

4. دو عدالتوں کے متفقہ فیصلے:

رینٹ کنٹرولر اور لوئر اپیلٹ کورٹ دونوں نے بے دخلی کا حکم دیا، جس کی ہائی کورٹ نے توثیق کی۔

5. نقص کی اصلاح:

عدالت نے قرار دیا کہ پاور آف اٹارنی میں نقص قابلِ اصلاح تھا، اور عملی طور پر اسے درست کر دیا گیا تھا۔

6. آئینی درخواست مسترد:

ہائی کورٹ نے کہا کہ دو نچلی عدالتوں کے فیصلے درست ہیں اور آئینی درخواست میں مداخلت کی ضرورت نہیں۔

نتیجہ:

درخواست گزار کی آئینی درخواست مسترد کر دی گئی، اور بے دخلی کے احکامات برقرار رکھے گئے۔

----S. 15---Constitution of Pakistan, Art. 199--- Constitutional petition---Ejectment of tenant---Power of attorney---Ratification of authority---Death of principal---Eviction of petitioner/tenant was sought by a person holding joint power of attorney executed by two Matwali of the trust---Rent Controller and Lower Appellate Court concurrently passed eviction order---Petitioner/tenant assailed eviction proceedings on the plea that one of the two principals who executed power of attorney had died before filing of rent case---Validity---Current Mutawalis had the authority under Waqfnama to appoint a person to institute proceedings for eviction of petitioner/tenant---It was open to Mutawalis to ratify unauthorized act on the part of attorney, as the defect was curable---Defect had already been impliedly achieved by defending appeal before Lower Appellate Court and proceedings before High Court---High Court declined to interfere in concurrent orders passed by two Courts below---Constitutional petition was dismissed, in circumstances.
