The tenor of the language used in the first proviso to Article 71 of the Qanun-e-Shahadat Order, 1984 leads this court to the conclusion that evidence contemplated under Article 71 of the Qanun-e-Shahadat Order, 1984 envisages personal testimony based on the memory of the person who has seen, heard, or perceived a fact.

آرٹیکل 71: ذاتی گواہی

آرٹیکل 71 کے تحت، کسی بھی قانونی معاملے میں پیش کی جانے والی گواہی صرف ان افراد کی ذاتی یادداشت اور مشاہدے پر مبنی ہونی چاہیے جو واقعے کے عینی شاہد ہوں۔ اس آرٹیکل کا مقصد یہ ہے کہ گواہی کو زیادہ قابل اعتبار بنایا جائے، کیونکہ یہ براہ راست مشاہدات اور تجربات پر مبنی ہوتی ہے۔ اس کی رو سے، گواہی کی نوعیت اس بات کی عکاسی کرتی ہے کہ گواہ نے خود واقعے کو دیکھا، سنا یا محسوس کیا ہو، اس طرح یہ قانونی نظام میں عدلیہ کو صحیح فیصلے کرنے میں مدد فراہم کرتی ہے۔

تشریح

آرٹیکل 71 کے تحت دی جانے والی گواہی میں ذاتی تجربات کا ہونا ضروری ہے، جس کا مطلب یہ ہے کہ گواہ اپنی یادداشت کی بنیاد پر بیان دے گا، اور اس گواہی کو دوسرے لوگوں کی کہانیوں یا قیاس آرائیوں کی بنیاد پر نہیں ہونا چاہیے۔ یہ قانونی اصول اس بات کو یقینی بناتا ہے کہ گواہی کی صداقت اور صحیح معلومات فراہم کی جائیں۔
