Land been declared as Chiragah was not permitted to be changed for its character

کیس راجہ طاہر محمود بنام چیف کمشنر اسلام آباد میں عدالت نے فیصلہ دیا کہ چراگاہ کی زمین کی نوعیت تبدیل کرنا غیر قانونی ہے اور ضلع انتظامیہ کو حکم دیا کہ وہ اس زمین کی حفاظت کرے اور غیر قانونی ہاؤسنگ سکیموں کے خلاف کارروائی کرے۔ کیس راجہ طاہر محمود بنام چیف کمشنر اسلام آباد و دیگر (رٹ پٹیشن نمبر 2921 سال 2019، فیصلہ 20 مارچ 2023) میں درخواست گزار نے الزام لگایا کہ چراگاہ کی زمین، جو کہ لکڑی جلانے، مویشیوں کے چرنے وغیرہ کے لیے مختص کی گئی تھی، کو غیر قانونی ہاؤسنگ سکیموں کے لیے تبدیل کیا جا رہا ہے۔ عدالت نے اس معاملے کو ویسٹ پاکستان لینڈ ریونیو ایکٹ 1967 کی دفعہ 42 کے تحت دیکھا اور یہ قرار دیا کہ ایسی زمین جو چراگاہ کے طور پر مختص کی گئی ہو، اس کی نوعیت کو تبدیل کرنا یا اسے کسی اور مقصد کے لیے استعمال کرنا غیر قانونی ہے۔ عدالت نے ہدایت کی کہ ضلع انتظامیہ اس زمین کی حالت کو شرط واجب الا عرض کے مطابق برقرار رکھنے کی پابند ہے۔ ممبر بورڈ آف ریونیو/چیف کمشنر اسلام آباد کو حکم دیا گیا کہ وہ اس زمین کی حفاظت کریں اور اگر کوئی ہاؤسنگ سکیم یا فرد اس پر قبضہ کرتا ہے تو اس کے خلاف قانون کے تحت کارروائی کی جائے۔ چیف کمشنر اسلام آباد سے توقع کی گئی کہ وہ ہر ممکن طریقے سے زمین کی اصل حیثیت کو بحال کریں۔ درخواست گزار کے خدشات کو مدنظر رکھتے ہوئے عدالت نے درخواست نمٹا دی اور دیگر متعلقہ ہدایات بھی جاری کیں۔

West Pakistan Land Revenue Act (XVII of 1967)--- ----S.42---Shamlat deh land---Shart Wajib ul Arz---Land mafia restrained from changing the nature of land---Petitioner alleged that grazing land, as a common land reserved for firewood, animal Chiragah etc. was being changed for development of illegal housing society---Validity---Any land which had been declared as Chiragah was not permitted to be changed for its character, nor 'notore' was permissible and District Administration was bound to implement and protect its character as defined in Shart Wajib-ul-Arz---In such circumstances, the claim submitted by the petitioner qua khasra numbers which had allegedly been converted by different housing schemes and individuals, shall be dealt by the Member Board of Revenue/Chief Commissioner, Islamabad, and all kinds of Chiragah should have been given protection---Chief Commissioner, Islamabad, could exercise its powers to protect such land and any housing scheme which encroached upon the Chiragah, action should have been taken against such individual or housing society under law---Chief Commissioner, Islamabad, was expected to restore the status of Chiragah by all means---Similarly Board of Revenue shall issue Notification of Abadi-Deh within Islamabad Territory after adopting procedure under the law---Petition was disposed of with said observations and other relevant directions.
