کیس 2024 MLD 1363 میں، جس میں دفعہ 489-F کے تحت چیک کی دھوکہ دہی کا الزام تھا، عدالت نے ملزم کو ضمانت پر رہا کر دیا۔ ایف آئی آر میں چیک کے اجرا کی تفصیلات غائب تھیں، جیسے رقم دینے کی وجہ اور مقصد، جس سے یہ واضح ہوا کہ مزید تفتیش ضروری ہے۔ اس بنا پر، دفعہ 497 (2) Cr.P.C. کے تحت ضمانت دی گئی۔

2024 MLD 1363 میں درج کیس میں، جس میں پاکستان پینل کوڈ (P.P.C.) کی دفعہ 489-F کے تحت چیک کی دھوکہ دہی کا الزام تھا، عدالت نے ملزم کو ضمانت پر رہا کرنے کا فیصلہ کیا۔ اس فیصلے کی بنیاد یہ تھی کہ ایف آئی آر میں چیک کے اجرا کی صورت حال کی تفصیل فراہم نہیں کی گئی تھی۔ خاص طور پر، ایف آئی آر میں یہ نہیں بتایا گیا کہ complainant نے ملزم کو رقم کیوں دی، کس مقصد کے لیے دی، اور یہ رقم ملزم پر کیسے واجب تھی۔ تحقیقات نے ان پہلوؤں کی وضاحت نہیں کی، جس سے یہ ظاہر ہوتا ہے کہ دفعہ 489-F کی درخواست کے لیے مزید تفتیش کی ضرورت ہے۔ لہذا، دفعہ 497 (2) Cr.P.C. کے تحت مزید جانچ کی ضرورت کو مدنظر رکھتے ہوئے، ملزم کو ضمانت پر رہا کرنے کا فیصلہ کیا گیا۔
