PLD 2023 Lahore 446 کی رپورٹ میں ذکر ہے کہ حق مہر کی وصولی کے لئے درخواست --- نکاحنامہ میں وکیل، ذمہ داری کا --- دائرہ کار --- 1964 کے فیملی کورٹ ایکٹ کے تحت فیملی کورٹ کے پاس ان معاملات کا اختیاری اختیار تھا جو اس ایکٹ کے شیڈول کے حصہ اول میں ذکر ہیں اور کوئی رکاوٹی بندش نہیں تھی کہ حق مہر کی درخواست کرتے ہوئے، صرف دلہن / شوہر کو مقدمہ میں شامل کیا جا سکتا ہے اور کسی اور کو نہیں --- اگر کوئی اور شخص حق مہر کی ضمانت دی ہو یا اس نے حق مہر کی ادائیگی کی ضمانت دی ہو تو وہ قانونی طور پر مقدمہ میں شامل کیا جا سکتا ہے --- حق مہر کے لئے ضامن اور ضمانت دینے والا دلہن کے شوہر کی طرح حصہ ہیں اور حق مہر ادا کرنے کے لئے ان پر ذمہ دار ہیں۔

اگر حق مہر کی بابت کوئی بندہ ضمانتی بنتا ہے تو اگر عورت کو حق مہر نہیں ملتا تو وہ ضمانتی سے اسے لے سکتی ہے۔

Suit for recovery of dower --- Wakeel in Nikahnama , liability of --- Scope --- Family Court under Section 5 of the Family Court Act , 1964 had exclusive jurisdiction to entertain . hear and adjudicate upon matters specified in Part I of the Schedule to the said Act and there was no barring provision that while claiming dower from the husband , only bridegroom / husband can be impleaded in the suit for recovery of dower and none else --- If another person has stood surety or has guaranteed the payment of dower , he / she can lawfully be impleaded in the suit --- Surety and guarantor to the dower are as much party and liable to pay dower as the bridegroom himself .
