New Law of rape, and amendment in law of rape.

 Criminal Law (Amendment Offences Relating to Rape) Act, 2016 - Key Amendments:

#### 1. **Non-Compoundable Offences:**

   - **Section 55 of PPC Amended:** Offences related to rape are now non-compoundable, meaning they cannot be settled through mutual agreement or compensation.

   - **زناء کے مقدمات اب ناقابل راضی نامہ ہیں۔**

#### 2. **Punishments for Rape:**

   - **Section 376 of PPC Amended:** 

     - **Rape of Minors or Persons with Disabilities:** Perpetrators can be punished with death or life imprisonment.

     - **اب جو بھی نابالغ یا کسی ذہنی مریض سے زناء کرے گا، اسے سزائے موت یا عمر قید کی سزا سنائی جا سکتی ہے۔**

   - **Public Servants Committing Rape:** If a public servant (including police officers, medical officers, or jailors) commits rape by abusing their position, they shall be punished with death or life imprisonment and a fine.

     - **جب کوئی سرکاری ملازم جیلر، پولیس یا میڈیکل آفیسر اپنے اختیارات کا ناجائز فائدہ اٹھا کر ریپ کرے گا تو اسے بھی سزائے موت یا عمر قید کی سزا ہوگی۔**

#### 3. **Victim Protection:**

   - **Section 376A Inserted:** Disclosure of the identity of a rape victim is prohibited.

   - **متاثرہ کا نام ظاہر کرنا ممنوع ہے۔**

#### 4. **Investigation and Trial Procedures:**

   - **Statement Recording:**

     - The investigation officer must record the statement of the victim in the presence of a female police officer or a female family member of the victim.

     - **متاثرہ کا بیان لیڈی پولیس آفیسر کی موجودگی میں یا متاثرہ کی اپنی کسی فی میل فیملی ممبر کی موجودگی میں لیا جائے گا۔**

   - **FIR Registration:**

     - The FIR must be recorded in the presence of a female police officer.

     - **پولیس مقدمہ درج بھی فی میل پولیس آفیسر کی موجودگی میں کرے گی۔**

#### 5. **DNA Testing:**

   - DNA tests are mandatory but require the consent of the victim or their legal heirs. The investigation officer must send DNA samples to the forensic laboratory as soon as possible.

   - **ڈی این اے ٹیسٹ کرنا لازمی ہے مگر متاثرہ کی مرضی سے۔**

#### 6. **Expedited Trials:**

   - **Section 344A Inserted:** Courts are required to conclude trials for rape offences within three months.

   - **زناء کے مقدمہ کا فیصلہ تین ماہ کے اندر ہونا لازمی ہے۔**

### Summary

The **Criminal Law (Amendment Offences Relating to Rape) Act, 2016** introduces stringent measures and protections to address the crime of rape, ensuring harsher punishments, victim protection, mandatory DNA testing, and expedited judicial processes.

زناء اور ریپ کے جرائم میں مندرجہ ذیل ترمیم کی گئ

Criminal Law (Amendment Offences Relating to Rape) Act, 2016 was passed in 2016.

This amendment inserted some new section and amended some section of PPC in order to make more strict laws for the offence of rape.

Section 55 of PPC is amended and offences related with rape are made non compounable

زناء کے مقدمات اب ناقابل راضی نامہ ہیں

Section 376 of PPC is also amended; now whoever commits rape of minor or person with mental or physical disability shall be punished with death or imprisonment of life.

اب جو بھی نابالغ یا کسی زہنی مریض سے زناء کرے گاا تو اسے سزاے موت یا عمر قید کی سزا سنائی جاسکتی ہے

It further stated that whoever being a public servant; including a police office, medical officer or jailor, taking advantage of his official position, commits rape shall be punished with death or imprisonment for life and fine.

جب کوئی سرکاری ملازم جیلر ,پولیس یا میڈیکل آفیسر اپنے اختیارات کا ناجائز فائد اٹھا کر ریپ کرے گا تو اسے بھی سزاے موت کی سزا ہوگی

Through this amendment, now disclosure of identity of victim of rape is also prohibited u/s 376A.

Law is also amended and it is compulsory for investigation officer to record statement of victim in presence of female police officer or other female family member of victim.

متاثرہ کا بیان لیڈی پولیس آفیسر کی موجودگی میں یا متاثرہ کی اپنی کسی فی میل فیملی میمبر کی موجودگی میں لیا جاے گا

Similarity it is also compulsory for Police to record FIR of such offence in presence of female police officer.

پولیس مقدمہ درج بھی فی میل پولیس آفیسر کی موجودگی میں کرے گی

Now under this amended law DNA test is compulsory but with the consent of victim or his legal heirs and it is duty of IO to send the samples of DNA to forensic laboratory as soon as possible.

A new section 344A is inserted in PPC which describes that court is bound to conclude the trial of offence related with rape in three months.
