A reading of  provision of S.145 CPC  clearly reflects that when a person becomes surety for performance of any decree or its part, or restitution of any property taken in execution of decree or payment of any money under an order of the Court in any suit or proceedings, the decree can be executed against him, to the extent for which surety has rendered himself personally liable in the manners, therein.

S.145 CPC کے پروویژن کا مطالعہ واضح طور پر اس بات کی عکاسی کرتا ہے کہ جب کوئی شخص کسی حکم نامے یا اس کے حصے کی کارکردگی کا ضامن بن جاتا ہے، یا کسی بھی مقدمے میں عدالت کے حکم کے تحت حکم نامے پر عمل درآمد یا کسی رقم کی ادائیگی کے لیے لی گئی کسی جائیداد کی واپسی یا کارروائی، اس کے خلاف حکم نامہ اس حد تک نافذ کیا جا سکتا ہے جس کے لیے ضامن نے خود کو آداب میں ذاتی طور پر ذمہ دار ٹھہرایا ہو۔
