سزائے موت میں عمر قید میں کمی کر دی گئی --- محرک ثابت نہیں ہوا --- استغاثہ کے مطابق ملزم اور مقتول کے نوکر کے درمیان جھگڑا ہوا --- مقتول نے مبینہ طور پر ملزم کی سرزنش کی اور اسی رنجش کی وجہ سے ملزم نے مقتول کے قتل کا ارتکاب کیا -- استغاثہ نے مقتول کے نوکر کو بھی پیش کیا تھا جس نے مقتول کے ملازم کو ملازمت سے رخصت کرنے کا کہا تھا جس نے مقتول کے ملازم کو نوکری سے فارغ کرنے کا کہا تھا۔ مقتول --- نوکر کے بیان کا باریک بینی سے جائزہ لینے سے معلوم ہوا کہ ملزم کا اصل محرک مذکورہ نوکر کے ساتھ تھا، اس لیے مقتول کے قتل کا اصل محرک راز میں پڑا ہوا ہے، ان حالات میں ملزم کو سزائے موت سنائی گئی سخت ہو گی --- نتیجتاً ملزم کی دفعہ 2، سی، 3 کے تحت تعزیراتِ پاکستان برقرار رہے گی۔ . ، اس کی سزائے موت کو عمر قید میں بدل دیا گیا۔

Death sentence reduced imprisonment for life --- Motive not established --- According to the prosecution , a quarrel took place between the accused and a servant of deceased --- Deceased allegedly reprimanded the accused and due to this grudge , the accused committed the murder of deceased -- Prosecution had also produced servant of the deceased , who in his statement deposed that the accused wanted him to work with him and asked him to leave the job of the deceased --- Bare perusal of the statement of the servant revealed that the real motive of the accused was with the said servant , therefore , the actual motive to commit the murder of in deceased remained shrouded mystery In these circumstances , the penalty of death awarded to the accused would be harsh --- Consequently , while maintaining the conviction of the accused under section 302 ( b ) , P.P.C. , his sentence of death was altered into imprisonment for life.
